Terms of Service

1. Service Agreement

By accessing or using CodeFyx's services, you agree to be bound by these Terms of Service. CodeFyx provides API-based services on an "AS-IS" basis without warranties of any kind.

2. SAFE AI Policy

CodeFyx is committed to responsible AI development through transparency and accountability.

Our SAFE AI Policy ensures:

• Secure: Proprietary algorithms protected as trade secrets, but full security audit logs provided
• Accountable: Complete audit trails, explainable results, and compliance reports for all API usage
• Fair: Transparent bias metrics and fairness reports (methodology is proprietary)
• Ethical: Full compliance documentation for SOC2, HIPAA, and GDPR with detailed reports

Important: While our algorithms are proprietary (protected IP), we provide complete transparency on API results, audit trails, and compliance documentation. You receive explainable outputs and detailed reports, but the underlying implementation remains confidential.

All services are provided AS-IS. You are solely responsible for how you use our APIs and the outputs they generate. We do not guarantee that our AI safety tools will prevent all harmful outputs.

3. Usage-Based Pricing & No Refunds

ALL PAYMENTS ARE FINAL. NO REFUNDS FOR API USAGE OR SUBSCRIPTIONS.

CodeFyx operates on usage-based pricing. You pay for API calls consumed and monthly subscription fees:

• Developer ($0/mo): 10,000 free calls/month, then $0.01-$0.50 per call
• Startup ($497/mo): 500K calls included, $0.001 per call after
• Growth ($2,497/mo): 5M calls included, $0.001 per call after
• Enterprise ($4,997/mo): Unlimited calls + 250TB data lake access

No Refunds Policy:

• API usage charges are non-refundable once consumed
• Monthly subscription fees are non-refundable (you may cancel future billing)
• No refunds for unused included API calls
• Start with free Developer tier to test before upgrading

4. Service Level & Performance

CodeFyx provides APIs and datasets with documented specifications. We commit to:

• 99% uptime SLA for API endpoints (excluding scheduled maintenance)
• API response times within documented specifications
• Full API documentation and integration guides
• Technical support for integration issues

While we maintain high standards, services are provided "AS-IS" regarding fitness for your specific use case. We document API behavior clearly - please review documentation before subscribing.

4. Limitation of Liability

CodeFyx shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from your use of our services, even if the services do not function as expected.

5. API Access & Documentation

CodeFyx provides pre-built API endpoints and curated datasets:

• Full API documentation including endpoints, parameters, and response formats
• Sample code and integration examples in multiple languages
• Dataset schemas and sample data for data lake assets
• Implementation details of underlying algorithms remain proprietary
• Reverse engineering or unauthorized redistribution is prohibited

You receive everything needed to integrate our APIs - documentation, samples, and support. Our internal implementation methods are trade secrets, but outputs are fully transparent and documented.

6. Free Developer Tier

Start with zero cost on the Developer tier:

• 10,000 free API calls per month (renews monthly)
• Access to all 47 APIs with full documentation
• Pay-per-use pricing after free allocation ($0.01-$0.50 per call)
• Credit card required for overage billing
• Automated AI support agent available 24/7
• No data lake access (Enterprise tier only)
• Upgrade anytime to higher tiers for better rates

7. Intellectual Property

All CodeFyx APIs, algorithms, data lakes, documentation, and related materials are the exclusive property of CodeFyx and are protected by intellectual property laws. You receive only a limited license to use the APIs as specified in your subscription tier.

8. Data Lake Access

If your subscription includes data lake access for AI training:

• Data is provided AS-IS without warranties of accuracy or completeness
• You may not redistribute or resell data lake access
• Data usage is subject to your subscription tier limits
• CodeFyx reserves the right to modify or discontinue data lake access without notice or refund

9. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble our APIs
• Share API keys, access credentials, or data lake access
• Exceed your subscription tier's limits
• Use services for illegal or harmful purposes
• Attempt to circumvent technical limitations or security measures
• Resell or redistribute API access to third parties

10. Termination

We reserve the right to suspend or terminate your access to CodeFyx services at any time, with or without cause, with or without notice. No refund will be provided upon termination for any reason, including service non-performance.

11. Changes to Terms

We reserve the right to modify these terms at any time without notice. Continued use of our services constitutes acceptance of modified terms.

12. Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration.
